Acceptance of Terms
Welcome to The Enneagram Institute Shopping Cart (the "Cart"). The following are the basic terms and conditions that govern your use of and purchase of products from our Cart. Please note that your use of our Cart constitutes your agreement to follow and be bound by these terms. If you do not agree to this Website Agreement and Terms of Use (this "Agreement"), please exit the Cart immediately and do not use or purchase products from our Cart.

The Enneagram Institute reserves the right to change this Agreement or terminate access to this Cart at any time, with or without notice. Your use of our Cart after such a change to the Agreement constitutes acceptance of the most current version of this Agreement.

Product Detail
Description: Products are described as accurately and appropriately as possible in order to ensure that a customer understands the nature of the product being ordered.

Color: Colors are represented as realistically as possible, but color variations of product images or color swatches are outside of the control of The Enneagram Institute because software, hardware, and Internet connections can alter the appearance of colors.

If you are unsatisfied with a product for these reasons, your sole remedy will be to return the product to The Enneagram Institute.

Corrections
While we make every effort to ensure the accuracy of product and price information, errors do occasionally occur. We reserve the right to correct any errors or inaccuracies at any time. We apologize for any inconvenience this may cause. If you are not completely satisfied with your purchase, you may return it for a refund.

Shipping
Our office is open Monday through Thursday from 9:00 am to 4:00 pm ET. For products that require shipping, please allow 5 - 7 business days. Express Mail will be shipped by the next business day after the order is received. Out of stock items will be restocked as quickly as possible and you will receive notification when they will be available.

Your Account
The Enneagram Institute will use all reasonable and professional means to protect the privacy of your account. The user is responsible for maintaining the confidentiality of information that could be used to access your account, such as user id and password, and the user agrees to accept all responsibility for all activities performed using your user id and password. Additionally, the user is responsible for restricting access to your computer and not using public computers to access your account.

The Cart only sells products to adults with credit cards. If you are under 18 you may use the Cart only with the approval and active involvement of a parent or guardian.

Risk of Loss
All items purchased from The Enneagram Institute are made pursuant to a shipment contract. This means that the risk of loss and title for such items passes to you upon our delivery to the carrier.

Privacy Policy
The Enneagram Institute collects the following information from customers that order from the Cart: name, shipping address, billing address, e-mail address and credit card information. This information is collected in order to fulfill orders placed online. This information will not be used to send customers information about products and services offered on the Cart or by The Enneagram Institute unless you sign up to be on our email or postal mailing list.

Users of the Cart can control how their personal information is used in the "Account Login" section of the Cart. However, if a user receives offers from The Enneagram Institute (e.g., e-mail, catalogs, special offers etc…) and the user does not want to receive these offers in the future, the user has a few ways of "opting out.” If the solicitation comes in the form of e-mail the e-mail will always have an opt-out link at the bottom; in addition, and you can always unsubscribe here: http://www.enneagraminstitute.com/UnSubNewsLetter.asp. Otherwise, the user is encouraged to contact The Enneagram Institute Customer Relations to request to be removed from our email and/or postal list.

Users of the Cart can have access to their own information in the "Account Login" section of the Cart and can correct any inaccuracies related to Cart orders.

Security of Personal Information/Credit Card Information
Providing a secure Cart is essential for your peace of mind and trust in The Enneagram Institute. Our Cart does not save your credit card information, so there is no risk of the numbers ever being transmitted or reused.

Applicable Law; Contract Interpretation
The Enneagram Institute's principal place of business is in New York, and The Enneagram Institute operates this Cart from its offices in New York. The laws of the State of New York apply to this Agreement, without regard to conflicts of laws principles. If any provision of this Agreement is ruled to be unlawful, void, or otherwise unenforceable, then that provision shall be deemed severable from this Agreement and shall not affect the validity and enforceability of any remaining provisions. This is the entire Agreement between you and The Enneagram Institute relating to the subject of this Cart.

Indemnity
You agree to defend, indemnify, and hold harmless The Enneagram Institute, its officers, directors, shareholders, employees, and agents from and against any claims, actions, or demands, including without limitation reasonable legal and accounting fees, arising from your use of this Cart or your breach of the terms of this Agreement. The Enneagram Institute shall provide notice to you promptly of any such claim, suit, or proceeding and shall assist you, at your expense, in defending any such claim, suit or proceeding.

Dispute Resolution
Any dispute arising with respect to this Agreement shall be resolved by negotiation between the parties or, if necessary, by resort to an appropriate federal or state court located in the State of New York. You expressly waive asserting any right to pursue any claim against The Enneagram Institute relating to this Agreement in any forum or venue located outside of the State of New York; in the event of the filing of any such claim, you stipulate to the transfer of the filing to any appropriate or available forum or court in the State of New York, at The Enneagram Institute's sole discretion.
